本文通过实际案例和有关文献报道,阐述杀人现场被害人的时空状态(被害人在受到攻击时所处的时间、地点和位置状况)在命案现场分析中的应用。通过分析案犯选择被害人所处时空状态的原因可判断案犯的作案动机;分析案犯获知特定时空条件的途径可判断案犯与被害人的熟悉程度;根据行为地理学原则分析案犯如何选择利用被害人的时空条件,可判断案犯居住活动场所和区域;被害人的时空状态特点还可作为串并系列杀人案的重要依据。综上,杀人现场被害人的时空状态在现场分析中具有重要的作用。

Since the criminal activity is ordinarily decided on rational judgment except for the passion-driven crime, the criminal usually chooses the appropriate time and locus to carry out offence for his/her own security and smooth realization of the criminal purpose. When an intentional perpetrator attacks a specific victim to death on a particular time and site, the spatio-temporal information from the victim will definitely leave important suggestions for analysis of the crime scene. This article, based on victim’s status (like time, location and other states) in scenes from seven cases, analyzed the reasons for the perpetrators to choose these conditions so that the inference and judgment could be made on the criminal motive, the relationship between the offender and victim, as well as the area of the dead’s living and activity. According to the aggressive behavior and the way to deal with the scene at the indicated site and time, the culprit can be deduced of his/her daily activities and living habits, and even familiarity about the crime scene. There is a certain relationship between different crime scenes and areas, exposing the clues of serial crimesm, if involved, and the residential/common-going information of the perpetrators. In a word, the victim’s spatio-temporal state can tell valuable intelligence for the involved case to solve, worth paying attention and analyzing deeply and thoroughly.
